1. Parties

These Terms govern the agreement between Ecobe Academy, operated by ECOBE ACADEMY EUROPE, LDA. (Portuguese tax ID 519390768), and the individual purchasing the Membership ("the Client", "you"). By purchasing, you confirm you have read and accepted these Terms.

These Terms apply to Clients acting as consumers, i.e. for purposes outside their trade, business, craft or profession (Article 3 of Decree-Law 24/2014). If you are purchasing on behalf of a company or as a self-employed professional for professional purposes, the consumer-protection provisions of Sections 5, 15 and 16 do not apply to you, and you confirm this capacity at checkout.

2. What You Get

Access to the JOB-HUNT-BOT AI assistant on WhatsApp, trained on Ecobe's HR methodology. Access to the JOB-HUNT-BOT platform, covering: positioning and job hunting plan, position search on major portals, CV customisation per role, contact identification and outreach message drafting, interview preparation. Ecobe's proprietary 5-step Job Hunt method. Technical support (Section 8).

Not included: one-to-one coaching, mentor review of your materials, direct access to the founder or mentors, applications or outreach done on your behalf, community access, live Q&A sessions, or anything listed as part of the Self-Driven or Partnership Programs.

3. No Guarantee of Outcome

Ecobe does not guarantee interviews, offers, employment, or any specific timeline. Outcomes depend on your market, your effort, and decisions by third parties. Past client results do not predict yours.

4. Price, Payment and Cancellation

Fee: CHF 150 per month, charged automatically monthly. Committed period: 4 months (CHF 600 total). After 4 months of active use, continued access is at no additional cost until you land a job, subject to Section 13. Cancellation must be by email; WhatsApp or verbal notice does not count.

5. 14-Day Withdrawal Right (Direito de Livre Resolução)

Under Articles 9 to 17 of Decree-Law 24/2014 of 14 February (transposing Directive 2011/83/EU), you have 14 days from the date this contract is concluded to withdraw, without giving any reason and without cost, by sending an unambiguous statement to ecobe@ecobeacademy.com.

JOB-HUNT-BOT is a continuous service (AI assistant access plus platform access), not "digital content not supplied on a tangible medium" within the meaning of Article 2(11) of Directive 2011/83/EU.

If you expressly request, in writing at the time of purchase, that performance begin before the 14-day period has elapsed, and you later withdraw after performance has started, you will owe an amount proportionate to the service already provided up to the date you notify us of your withdrawal, calculated pro rata temporis on the monthly fee (Articles 14 and 15 of Decree-Law 24/2014). If you withdraw before performance has started, you are entitled to a full refund. If you do not withdraw within the 14-day period, the Membership continues under Section 4. Refund requests: ecobe@ecobeacademy.com, processed within 14 days of a valid withdrawal.

6. Upgrade Path

If you upgrade to the Self-Driven Program or Partnership Program during your active membership, everything you have paid for JOB-HUNT-BOT is credited to the first instalment of the upgraded program. After membership ends, upgrades are at full price with no credit.

7. AI, Third-Party Tools and Your Responsibility

JOB-HUNT-BOT relies on AI providers (Anthropic Claude, OpenAI ChatGPT) and WhatsApp Business. Their terms apply. Ecobe is not responsible for their outages or errors. AI-generated content (CV drafts, outreach messages, position matches) may contain errors, including factual inaccuracies. You are solely responsible for reviewing and approving everything before using it externally. JOB-HUNT-BOT provides drafts; you make the final decisions.

8. Technical Support

For access, platform, or billing issues: ecobe@ecobeacademy.com. Response time: typically within 2 business days. Support does not include career advice, CV review, or interview coaching.

9. Data Protection (GDPR)

Ecobe processes your personal data (name, email, telephone, CV, LinkedIn, WhatsApp messages, platform inputs) to deliver the Services. Legal basis: contract performance (Article 6(1)(b) GDPR) and consent where applicable.

Your GDPR rights include access, rectification, erasure, portability, withdrawal of consent, and complaint to a supervisory authority (in Portugal, the CNPD). Contact ecobe@ecobeacademy.com to exercise them. Data is retained for the membership duration plus the period required by applicable law for tax and accounting records.

10. Intellectual Property and Confidentiality

All methodology, prompts, AI training, frameworks (including the 5-step Job Hunt Method), templates, and platform functionality are the property of Ecobe Academy and Giuliano Hippertt. You receive a limited, personal, non-transferable licence to use them solely for your own job search.

You may not: share, republish, or resell any JOB-HUNT-BOT outputs, prompts, or methodology; use the materials to deliver competing services; reverse-engineer the prompts or system; use Ecobe trademarks without written permission; allow anyone else to access the Services through your account. These obligations survive termination.

11. Limitation of Liability

To the maximum extent permitted by law, Ecobe's total liability is limited to the amount you paid in the 4 months preceding the claim. Ecobe is not liable for indirect or consequential damages, including lost income, lost opportunities, or missed jobs resulting from AI errors. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law.

12. Testimonials and Marketing

Providing a testimonial is voluntary and not required to use the Services. Ecobe will only use your name, image, or story for marketing where you give separate written consent.

13. Suspension and Termination

Ecobe may suspend or terminate access for breach of Terms, misuse, abusive behaviour, non-payment, or violation of law. Where Ecobe terminates for these reasons, any amount already paid for a service period not yet delivered is refunded pro rata, except where the breach involves fraud, wilful misconduct, or deliberate misuse of the intellectual property under Section 10, in which case no refund is due.

14. Changes to These Terms

Ecobe may update these Terms to reflect changes in services or regulation. Material changes will be notified by email at least 30 days in advance. Continued use after the change date constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer-protection rules of your country of habitual residence that cannot be derogated from by agreement. If you are a consumer domiciled in an EU Member State, you may bring proceedings against Ecobe either before the courts of Portugal or before the courts of your own place of domicile, and Ecobe may only bring proceedings against you before the courts of your place of domicile. For all other disputes, the courts of Lisbon have jurisdiction.

16. Alternative Dispute Resolution (RAL)

If you are a consumer and a dispute arises that we cannot resolve directly, you may refer it to a consumer alternative dispute resolution entity with jurisdiction over the matter and your area, such as the CNIACC or another entity listed at www.consumidor.gov.pt, in accordance with Law 144/2015 of 8 September.
